Fizgig® respects the privacy and the integrity of any information that you provide in the use of our APP and future web services. This Privacy Policy explains our policy regarding the collection, use and disclosure of your personal information.

This Privacy Policy will be continuously assessed against new technologies, business practices and our users’ needs. As we update, expand, and diversify our products and services, this Privacy Policy may evolve. Please check this Privacy Policy from time to time for updates by checking the date of the “Last Update” at the top of this document. If we make any material changes to this Privacy Policy, we will notify you here. You acknowledge and agree that your access of our APP and your use of our services following any posted changes to the Privacy Policy indicate your acceptance of such changes.

What privacy mean to us

Your privacy is our business. At Fizgig®, we are committed to protecting the privacy of our users, which is why we do not sell or rent any personal information or personally identifiable information regarding our users to any third party. We hope this Privacy Policy will answer your questions regarding how we treat personal information gathered from visitors to our APP and future web services. 

Changes to our policy

We are constantly improving our Services and must do so in compliance with federal and state laws, so we may need to change this Privacy Policy from time to time. We will alert you if there are any material changes by placing a notice on our APP, by sending you an email, via the Services and/or by some other means. Please note that if you’ve opted not to receive legal notice emails from us (or you haven’t provided us with your email address), those legal notices will still govern your use of the Services, and you are still responsible for reading and understanding them. By using, or otherwise accessing, the Services after any changes to the Privacy Policy have been posted, you are agreeing to said changes. 

What is personal information?

For the purposes of this Privacy Policy, personal information means information that can be used to identify and/or contact you, specifically your name, address, e-mail address, country of residence, as well as other information when such information is combined with your personal information. Personal information does not include “aggregate” information, which is data we collect about the use of our site and our services. Our privacy policy does not restrict or limit our collection and use of aggregate information.

Consent

You acknowledge and agree that by accessing our APP and future web services you fully understand, accept, and voluntarily consent to the collection, use, retention, and disclosure of personal information in accordance with this Privacy Policy. It is always your choice whether to provide us with your personal information, however, a decision to withhold personal information may restrict or prevent us from providing you with a particular product or service. We will only collect, use, and disclose your personal information with your consent, except where otherwise permitted or required by applicable law or regulatory requirement. 

Information collected by Fizgig® 

We may collect information that you provide directly to us through the following methods:

• When you use our Services, e.g., when you register for an account, request a service from a Pet Care Provider, or communicate with a Pet Owner looking for services from a Pet Care Provider.
• When you participate in surveys or fill out forms.

• When you register for promotions.
• When you request customer support and/or technical assistance.
• When you otherwise communicate with us or other users, including Pet Care Providers or Pet Owners, through the Services.

The information you provide directly to us may concern you or others and may include, but is not limited to, the following:

• Identifiers and Contact Information: We may collect identifiers and other contact information from you, such as your name, email address, phone number, and address. With your consent, you may also grant us access to your mobile device’s address book, through which we would collect and store on our servers all your contacts and their contact information. We use your contact information to help you find friends and other contacts who are Fizgig® users, and to facilitate you inviting friends and other contacts to use Fizgig®.
• Information Regarding Pets: For example, we may collect information regarding your pet, such as vaccinations and health history, primary veterinarian, age, videos and photographs of your pet.
• Financial Information: In your use of the Services, you may provide us or our service providers with financial information such as financial account or credit card account information.
• Location Information: We may collect general location information (e.g., inferred from your IP address) or specific location information (i.e., geolocation with your consent). For example, we may request geolocation information of Pet Care Providers when they are providing services for Pet Owners. 
• Communications: We may collect communications you make through the Services, such as when you communicate with us or other users. For example, Pet Owners may communicate with Pet Care Providers through tools offered on the Services or you may communicate with our customer success team or other members of the Fizgig® team through email, text message or telephone. If you send text messages with a Pet Owner or Pet Care Provider using the telephone number for that user available on the Services, we may use a third-party service provider to track these text messages. We track these text messages for fraud prevention, to enforce our Terms, and for quality and training purposes. As part of this process, Fizgig® will receive in real time and store data about your text message, including the date and time of the text message, your phone number, and the content of the text message.

Use of your personal information

You acknowledge that Fizgig® may use personal information that you voluntarily disclose to us to:

• Provide you with information about new products, services, newsletters, informative e-mails, and research on future product ideas or improvements.
• Assist us in creating or providing content that is relevant to you.
• Provide you with special offers that may be of interest to you and to improve your experience on our Web sites or with our services.
• Assist us in creating better products and services to meet your needs.
• Allow you to purchase and download products, obtain access to services, or otherwise engage in activities you select.
• Provide you with technical support.
• Help you quickly find software, services, or product information important to you.
• Send transaction-related communications such as welcome letters, and product/service order confirmations. Fizgig® may also send you surveys or marketing communications to inform you of new products or services or other information that may be of interest.
• Restrict the availability of some of the products, services, and content to certain parts of the world, where required for legal reasons, by using your address, IP address and other information to enforce those restrictions.
• Enhance our Service’s functionality or features, providing you with information about specials and stores, and to otherwise operate our business. We may also share certain information, such as Location Information with our business partners so that they may better serve you with offers or otherwise.
• You may always choose not to provide personal information, but if you so choose, our products and services may not be available to you. You agree that you are under no obligation to provide us with this information and can access many aspects of our Web sites and services without providing us any personal information.

Disclosure of your personal information

Except as otherwise disclosed to you, Fizgig®  will not sell or rent your personal information to any other party and will only use and disclose your personal information for the purposes for which it was collected as described in this Privacy Policy. However, you agree that Fizgig®  may disclose your personal information in the circumstances set out below:

• Fizgig® may disclose your personal information with your prior consent.
• Fizgig® may be required by law to disclose personal information without your consent in the event of emergency situations or when required by government or other legal authority.
• Fizgig®  may also disclose personal information to third parties in connection with a corporate reorganization, merger or amalgamation, or the sale of all or substantially all of our assets, provided that, where appropriate, any party to whom the information is disclosed is bound by agreements or obligations, and required to use or disclose your personal information in a manner consistent with the use and disclosure provisions of this Privacy Policy, unless you consent otherwise; or
• Fizgig® may share your personal information with service providers who perform services on our behalf. For example, we may hire other companies to handle the processing of payments, collect debts, to provide data storage, to host websites, to fulfill orders, to assist in direct marketing, to conduct audits, etc. Those companies will be permitted to obtain only the personal information they need to provide the service. Each company is bound by agreement or obligations with Fizgig®  to implement and maintain reasonable security procedures and practices in order to use and disclose your personal information in a manner consistent with the use and disclosure provisions of this Privacy Policy, unless you consent otherwise.

Our policy and children information 

Our Services are not designed for minors under 18. Only persons 18 years of age or older may use the Services. If we discover that an individual under 18 has provided us with personal information, we will close the account and delete the personal information to the extent required by the Children’s Online Privacy Protection Act. We may, where permitted by law, retain certain information internally for purposes described in this Privacy Policy.

How does Fizgig® protect your information?

Your account is protected by a password for your privacy and security. If you access your account via a third-party site or service, you may be offered additional or different sign-on protections from that third-party site or service. You must prevent unauthorized access to your account and information by selecting and protecting your password and/or other sign-on mechanism appropriately and limiting other’s access to your computer or device and browser by signing off after you have finished accessing your account. We are not responsible for any unauthorized password activity within your account.

We implement technical, administrative, and physical safeguards to protect the information we collect from unauthorized access, disclosure, alteration, or destruction. We cannot, however, guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

Opt-out and withdrawing consent

You can withdraw your consent for the use of your personal information at any time by notifying us at privacy@Fizgigapp.com or by changing your application permission levels. Information may be retained by Fizgig® for audit or archival purposes or as required by applicable federal and provincial laws.

How long does Fizgig® keep personal information? 

Fizgig® maintains information about you for as long as we provide service to you, and longer for related business activities. After information is no longer necessary for our or our customer’s business purposes, we destroy the information unless there is an outstanding request or order to preserve the information.

How to access your personal information

You can ask to see your personal information. If you want to review, verify, or correct your personal information, please contact us directly at privacy@Fizgig®.com. Please note that any such communication must be in writing. Generally, your information is kept at our corporate offices in Pembroke Pines, Florida (see address information below).

When requesting access to your personal information, please note that we may request specific information from you to enable us to confirm your identity and right to access, as well as to search for and provide you with the personal information that we hold about you. We will not charge you a fee to access your personal information; however, we will advise you of any fee in advance, should one arise. Your right to access the personal information that we hold about you is not absolute. There are instances where applicable law or regulatory requirements allow or require us to refuse to provide some or all the personal information that we hold about you. In addition, the personal information may have been destroyed, erased, or made anonymous in accordance with our record retention obligations and practices.

If we cannot provide you with access to your personal information, we will endeavor to inform you of the reasons why, subject to any legal or regulatory restrictions.

Notice to California Residents

If you are a California resident, California Civil Code Section 1798.83 and California Consumer Privacy Act permits you to request information regarding the disclosure of your personal information by Fizgig® to third parties for the third parties’ direct marketing purposes. Explanation of this Privacy Policy

This Privacy Policy does not create or confer upon any individual any rights, or impose upon Fizgig® any obligations, in addition to any rights or obligations imposed by US applicable federal and state privacy laws.  Should there be any inconsistency between this Privacy Policy and US applicable federal and state privacy laws, this Privacy Policy will be revised to comply with the applicable privacy laws.

Any services provided by Fizgig®  is controlled and operated by Fizgig®   from the United States of America, and we do not intend that our services subject us to the laws or jurisdiction of any state, country or territory other than that of the United States of America. We do not represent or warrant that the services, or any part of the services, are appropriate or available for use in any particular jurisdiction. Those who choose to access the services do so at their own volition and at their own risk, and are responsible for complying with all local laws, rules, and regulations. We may limit the services’ availability, in whole or in part, to any person, geographic area or jurisdiction we choose, at any time and in our sole discretion.
